2. Information We Process
### 2.1 Workout Data Stored on Your Device
When you use Gain, the app may process workout-related information such as:
- workout plans
- exercises and exercise settings
- workout logs
- progress and analytics derived from your logged workouts
- app preferences and settings
- locally created exports of your data
This information is stored locally on your device, including through on-device SQLite storage.
### 2.2 Purchase and Subscription Data
If you purchase premium access, Apple, Google, and RevenueCat may process information needed to manage your purchase and subscription status, such as:
- product identifiers
- purchase receipts or purchase tokens
- transaction identifiers
- subscription status
- entitlement status
- pseudonymous app or device-related identifiers used to validate purchases
We do not receive or store your full payment card details.
### 2.3 Communications
If you contact us by email regarding the App, we may process:
- your name
- your email address
- the contents of your message
- any other information you choose to provide
### 2.4 Information We Do Not Intentionally Collect Through the App
The App does not currently require user accounts and does not intentionally collect cloud-hosted workout data, third-party analytics data, or crash-reporting data through the App itself.
3. How We Use Information
We use information only as needed to:
- provide the app's core functionality
- store and display your workout plans, workouts, and progress on your device
- enable imports and exports initiated by you
- manage paid features and subscription access
- respond to support requests or other messages
- comply with legal obligations
4. Legal Bases Under GDPR
Where the GDPR applies, we process personal data on the following legal bases:
- Performance of a contract: to provide the app and any paid features you request
- Legitimate interests: to respond to inquiries and administer the App responsibly
- Legal obligation: where processing is required by tax, accounting, consumer, or other applicable laws
- Consent: where consent is required by law
5. Local-First Storage and Retention
### 5.1 App Data
Your workout data is stored locally on your device and remains there until you delete it, export it, or remove the app.
If you delete the app, locally stored app data is generally removed from your device, subject to your device, operating system, backups, and any local export files you created yourself.
### 5.2 Exported Data
If you export data from the app, the exported file is stored wherever you choose to save it. You are responsible for managing and deleting exported files.
### 5.3 Purchase Records
Subscription and transaction records are processed by Apple, Google, and RevenueCat under their own retention practices and policies.
### 5.4 Support Messages
If you contact us, we keep communications for as long as reasonably necessary to respond, document the request, resolve follow-up issues, and comply with legal obligations.
6. Sharing and Service Providers
We do not sell your personal data.
We may rely on the following providers:
- Apple App Store: app distribution, payments, subscriptions, refunds, and related transaction records for iOS
- Google Play: app distribution, payments, subscriptions, refunds, and related transaction records for Android
- RevenueCat: subscription and entitlement management
These providers process data under their own terms and privacy policies.
7. International Transfers
Because Gain is local-first, your workout data is generally not transferred to our servers.
However, if you use paid features or contact us, Apple, Google, RevenueCat, or email providers may process data outside Germany or the European Economic Area. Where applicable, such transfers are handled by the relevant provider under its legal transfer mechanisms and contractual safeguards.
8. Your Rights
If the GDPR applies to you, you may have the right to:
- access your personal data
- request correction of inaccurate data
- request deletion of personal data
- request restriction of processing
- object to processing based on legitimate interests
- receive data portability where applicable
- withdraw consent where processing is based on consent
- lodge a complaint with a supervisory authority
Because Gain does not require user accounts and stores workout data locally, many rights can be exercised directly by you inside the app or by deleting the app and local files.
You can also contact us at mail@maximilian-kuerschner.de.
9. Children
Gain is not intended for children and may only be used by persons who are at least 18 years old. We do not knowingly target or intentionally collect personal data from children.
10. Fitness and Health Disclaimer
Gain is a workout tracking and organization tool. It is not intended to provide medical advice, diagnosis, treatment, or professional fitness supervision.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will update the date above and may provide additional notice in the app or on the website where appropriate.
