Please read these Terms of Use ("Terms") carefully before using the cashbook mobile application (the "App") operated by Maximilian Kürschner ("we", "us", or "our").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

You may NOT:

  • Copy, modify, or distribute the App or its content
  • Reverse engineer, decompile, or disassemble the App
  • Rent, lease, sell, or sublicense the App
  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any part of the App or its systems

3. User Responsibilities

You are responsible for:

  • Maintaining the confidentiality and security of your device
  • All activities that occur on your device using the App
  • Ensuring the accuracy of the data you enter
  • Backing up your data (the App stores data locally on your device)
  • Complying with all applicable laws when using the App

4. Intellectual Property Rights

The App, including all content, features, functionality, source code, and design, is owned by Maximilian Kürschner and is protected by international copyright, trademark, and other intellectual property laws.

All trademarks, logos, and service marks displayed in the App are the property of their respective owners.

5. In-App Purchases and Subscriptions

### 5.1 Premium Features

The App may offer premium features available through in-app purchases or subscriptions ("Premium Features"). By purchasing Premium Features, you agree to the following terms:

  • Prices are displayed in the App and may vary by region
  • Payment will be charged to your Apple App Store or Google Play Store account
  • Prices are subject to change with notice
  • All purchases are processed by Apple or Google according to their terms

### 5.3 Subscriptions

  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage subscriptions and turn off auto-renewal in your device's account settings
  • Cancellation takes effect at the end of the current billing period

### 5.4 Refunds

  • Refund requests are subject to Apple App Store or Google Play Store refund policies
  • We do not directly process refunds; please contact Apple or Google for refund requests
  • Canceling a subscription does not provide a refund for the current billing period

### 5.5 Free Trials

  • Free trial periods (if offered) are for new users only
  • You may be charged when the trial period ends unless you cancel before the trial expires
  • We reserve the right to determine free trial eligibility

6. AI-Powered Features

The App uses artificial intelligence <!-- (Ollama) --> (OpenAI API) to suggest expense categories. While we strive for accuracy, AI suggestions are not guaranteed to be correct. You are responsible for verifying and approving all categorizations.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Guarantees that the App will be uninterrupted, error-free, or secure
  • Accuracy, reliability, or completeness of any content or data

You use the App at your own risk. We do not warrant that the App will meet your requirements or that defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Maximilian Kürschner SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or use
  • Damages arising from your use or inability to use the App
  • Any damages exceeding the amount you paid for the App (including in-app purchases) in the 12 months preceding the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so these limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Maximilian Kürschner from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any data you input into the App

11. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Any reason at our sole discretion

Upon termination, your license to use the App will immediately cease. Data stored locally on your device will remain until you delete the App.

12. Changes to the App

We reserve the right to:

  • Modify, suspend, or discontinue any feature of the App at any time
  • Update the App to improve functionality, fix bugs, or add features
  • Change pricing for Premium Features with reasonable notice

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms in the App
  • Updating the "Last Updated" date
  • Providing an in-app notification

Your continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Germany, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Germany.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Maximilian Kürschner regarding the App and supersede all prior agreements and understandings.

17. No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision.

18. Apple App Store and Google Play Store

### 18.1 Apple App Store

If you downloaded the App from the Apple App Store, you acknowledge that:

  • These Terms are between you and Maximilian Kürschner, not Apple
  • Apple has no obligation to provide maintenance or support for the App
  • Apple is not responsible for any product liability claims, intellectual property claims, or third-party claims
  • Apple and its subsidiaries are third-party beneficiaries of these Terms

### 18.2 Google Play Store

If you downloaded the App from the Google Play Store, your use is also subject to Google Play's Terms of Service.
